Terms of Service

1. Acceptance of terms

By downloading, installing, or using the PawCodex application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users, including free-tier users, Pro subscribers, and Professional-tier subscribers. Additional terms may apply to paid subscription plans and are incorporated here by reference.

2. Eligibility

You must be at least 18 years of age to create an account and use PawCodex. By using the Service, you represent that you meet this requirement. Users under 18 may use the Service only under the supervision of a parent or legal guardian who agrees to these Terms on their behalf.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@pawcodex.com if you suspect unauthorised access to your account.

You may not share your account credentials with others, create accounts using false information, or use another user's account without permission.

4. Subscription plans and billing

PawCodex offers the following plans:

• Free: Available at no charge. Includes up to 2 pets, 2 caregivers, and 6 months of history.
• Pro: Paid monthly or annually. Includes all Free features plus unlimited history, AI analysis, PDF export, and Apple Critical Alerts.
• Professional: Paid monthly or annually. Designed for breeders, rescues, kennels, and veterinary clinics. Includes all Pro features plus multi-user management and expanded pet limits.
• Lifetime: A one-time purchase granting lifetime access to all features available at the time of purchase and future feature updates.

Subscription fees are billed in advance on a monthly or annual basis. All payments are processed through Apple App Store or Google Play. Refunds are subject to the respective platform's refund policy. We do not offer refunds directly except where required by applicable law.

We reserve the right to modify pricing with at least 30 days' notice to existing subscribers. Price changes will not affect your current billing period.

5. Acceptable use

You agree not to use PawCodex to:

• Violate any applicable law or regulation.
• Upload false, misleading, or fraudulent health data.
• Attempt to reverse engineer, decompile, or extract source code from the application.
• Interfere with or disrupt the Service or servers connected to it.
• Resell, sublicense, or commercially exploit the Service without our written consent.
• Use automated tools to scrape or extract data from the Service.

6. Your data and content

You retain ownership of all health data and content you enter into PawCodex. By using the Service, you grant PawCodex Labs a limited, non-exclusive licence to store, process, and transmit your data solely to provide the Service to you.

We will not use your pet's health data to train AI models without your explicit consent. Anonymised and aggregated data (which cannot be linked back to you or your pet) may be used to improve our services.

7. Medical disclaimer

PawCodex is a logging and informational tool. All AI-generated insights, trigger identifications, pattern analyses, and medication information provided through the Service are for informational purposes only and do not constitute veterinary advice.

Never delay seeking veterinary care or disregard professional veterinary advice based on information you receive from PawCodex. In an emergency, contact your veterinarian or an emergency animal hospital immediately.

8. Caregivers and shared access

When you invite a caregiver, you are granting them access to your pet's health data according to the role permissions you assign. You are responsible for managing caregiver access and revoking it when appropriate. PawCodex Labs is not responsible for actions taken by caregivers you have invited.

9. Limitation of liability

To the maximum extent permitted by applicable law, PawCodex Labs and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or harm to your pet — arising out of your use of or inability to use the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.

10. Termination

You may cancel your account at any time through the app settings or by contacting support@pawcodex.com. Upon cancellation, your data will be retained for 30 days before deletion, giving you time to export it.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.

11. Governing law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Alberta, Canada.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
